1. Application for Divorce

Divorce Proceedings are commenced by way of the completion of a Divorce Petition. There are five grounds for a divorce which include:-

a. A Petition based on adultery;
b. A Petition based on unreasonable behaviour;
c. A Petition based on two years’ separation (with consent);
d. A Petition based on five years’ separation (without consent);
e. Desertion.

Very rarely will Divorce Proceedings be commenced on desertion, and therefore Divorce Proceedings will usually be based on the remaining four options listed above.

We will provide all necessary documentation plus instructions to complete Divorce Petition in order for these to be sent to the County Court.
